Terms of Service

These Terms of Service ("Terms") govern your use of Set it Now ("the App"), developed by Tim ("we", "us", "our"). By using the App, you agree to these Terms.
1. Acceptance of Terms
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
2. Description of Service
Set it Now is a daily planner application that helps you manage tasks, calendar events, work shifts, habits, journal entries, and shopping lists. The App includes features such as shared calendars, a voice assistant, and AI-powered task categorisation. The App is available on iOS, Android, and the web.
3. User Accounts
- An anonymous account is created automatically when you first use the App so you can start planning immediately.
- You may upgrade to a Google or email/password account to sync data across devices.
- AI-powered features (see Section 6) and cloud-backed directions lookups require a permanent account. Anonymous accounts cannot access these features to protect our service against abuse and to control operating costs.
- You are responsible for maintaining the security of your account credentials.
- You may delete your account and all associated data at any time from the Settings screen.
4. User Content
- You retain ownership of all content you create in the App (tasks, events, shifts, habits, journal entries, lists).
- You grant us a limited license to store and process your content solely to provide the App's services, including AI-powered categorisation.
- You are solely responsible for the content you create. Do not use the App for unlawful purposes.
5. Shared Calendars
- You may create shared calendars and invite other users by email address.
- When you share a calendar, invited members can view and add events to that calendar. Your display name and email are visible to other members.
- As the calendar owner, you can remove members at any time. Members can leave a shared calendar at any time.
- You are responsible for only sharing calendars with people you trust. We are not responsible for how other members use shared calendar data.
6. Voice Assistant & AI Features
- The voice assistant processes your queries locally against your own task and event data. Speech recognition is performed on-device by your operating system.
- AI-powered features (task classification, daily briefings, schedule building, weekly optimisation, task breakdown, and analytics insights) may send task titles, tags, times, durations, and completion data to Google Gemini for processing. See our Privacy Policy Section 1.7 for the specific data sent by each feature.
- A permanent account is required. All server-backed AI features — including daily briefings, Build My Day, Optimise Week, Task Breakdown, Text-to-Speech, directions lookups, and Gemini-backed task classification — are available only to signed-in users with a Google or email/password account. Anonymous users see a permission-denied response when attempting these features, and local on-device fallbacks (such as keyword-based task tagging) are used instead where available. This limit protects the service against automated abuse and keeps usage-based AI costs sustainable.
- All data sent to AI services is sanitised to remove sensitive information. No passwords, email addresses, or location data is shared with AI services.
- We enforce per-user rate limits on AI and directions endpoints. If you exceed your limit, requests are temporarily refused — retry after the limit window resets.
- AI features are provided "as is" and may not always produce accurate results. You should verify AI-generated suggestions, schedules, and categorisations.
- Some AI features may require a Pro subscription.
7. Acceptable Use
You agree not to:
- Use the App for any illegal or unauthorised purpose
- Attempt to access other users' data or accounts
- Interfere with or disrupt the App's servers or infrastructure
- Reverse engineer, decompile, or disassemble the App
- Use automated systems to access the App in a manner that exceeds reasonable use
8. Third-Party Services
The App integrates with third-party services including Google Calendar, Microsoft Calendar, Apple Calendar, Google AdMob, Google Gemini AI, and Paddle (web payment processing). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or accuracy of third-party services.
9. Subscriptions, Payments & Refunds
The App offers a free tier and a Pro subscription at AUD $15 per year that unlocks additional features (Email-to-Task, AI task breakdown, AI Day Builder, live travel times, Export, premium themes, unlimited wellness habits and focus presets, monthly & yearly Wrapped, ad-free).
9.1 Mobile subscriptions (iOS & Android)
- Mobile subscriptions are billed through the Apple App Store or Google Play Store. Payment is charged to your store account at confirmation of purchase.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
- You can manage or cancel your subscription through your device's store settings (App Store > Apple ID > Subscriptions, or Google Play > Subscriptions).
- Refunds for mobile subscriptions are handled by Apple or Google according to their respective refund policies. We do not process mobile refunds directly.
9.2 Web subscriptions (Paddle)
- Web subscriptions are processed by Paddle.com Market Limited ("Paddle"), who acts as the merchant of record. Paddle handles payment, taxes (GST/VAT), invoicing and customer billing support on our behalf.
- The Pro subscription is billed annually at AUD $15. We will email you before renewal so there are no auto-renewal surprises.
- You can cancel at any time through the customer portal we provide in-app or via the cancellation link in your Paddle receipt. Cancellation stops future renewals; you keep Pro access until the end of the current paid period.
- For billing questions, invoice copies or payment-method changes, you can contact Paddle support directly via the Contact link in any Paddle receipt, or contact us at tim@setitnow.online.
9.3 Refund policy (web subscriptions)
Pro subscriptions purchased through our website are non-refundable for change of mind. The free tier is comprehensive enough to evaluate the App before you upgrade, and pricing ($15 AUD/year) is shown clearly at checkout.
- When we will refund. We will issue a full or pro-rata refund where:
- You were charged twice for the same period (accidental duplicate purchase);
- You were billed after a cancellation that we failed to apply;
- An extended service outage of our doing prevented you from using Pro features for a meaningful portion of your billing period; or
- Applicable consumer law (including the Australian Consumer Law and EU/UK consumer rights) requires a refund — those statutory rights are not affected by this clause and override anything inconsistent with them in these Terms.
- How to request. Email tim@setitnow.online with your order ID (from your Paddle receipt) and the reason for the request. We aim to respond within 3 business days.
- How refunds are issued. Approved refunds are processed by Paddle to the original payment method, typically within 5–10 business days. Once a refund is issued, Pro access ends immediately.
- Chargebacks. Please contact us before initiating a chargeback — we are usually able to resolve disputes faster than the bank dispute process.
9.4 Pricing changes
We reserve the right to change subscription pricing. Existing subscribers will be notified by email at least 30 days before any price change takes effect, and any change will only apply to renewals on or after the notice period.
10. Advertisements
The free version of the App displays advertisements via Google AdMob. Ad content is provided by third parties and we do not endorse the products or services advertised.
11. Intellectual Property
The App, including its design, code, graphics, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.
12. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
13. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, missed reminders, or scheduling errors.
14. Termination
We reserve the right to suspend or terminate your access to the App at any time for violation of these Terms. You may stop using the App at any time by deleting your account and uninstalling the App.
15. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.
16. Governing Law
These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles.
